Terms of Use
Effective January 16th, 2025.
By using form-to-email.com (the "Service"), you (the "User") agree to the following Terms of Use ("Terms"). If you do not agree with these Terms, you must not use the Service, which is represented by the "Administrator".
1. Acceptance of Terms
By signing in to the Service, you confirm that you accept these Terms and agree to comply with them. By using the Service on behalf of an organization, you confirm you are authorized to bind the organization to these Terms.
2. Description of Service
Form, Email Template
The Service provides a web application for sending emails upon web form submissions without any server on the User side.
The User can create any number of distinct forms (each referred to as a "Form"), each with its own HTML "Email template" defined by the User.
The User can rename or delete any of their Form at any time.
Form Submission
Each Form has a HTTP endpoint supplied by the Service to the User.
Upon each valid request sent to this Form Endpoint (this request is called a "Form Submission"), the Service sends an email based on the User-defined email template and populated with the data submitted by the "Form End User" (not to be confused by the User of the Service).
In case of a malformed Form Submission, the Service responds with a specific error message instead of sending the email.
Form Submission data is also stored in a database and presented to the User for further review, without any time limit.
Spambot Check
When the Service receives a Form Submission, it always stores it on the database but does not send any email until the "Spambot Check" has succeeded for the Form Submission:
- In case of a Form Submission made with header
Content-Type: application/x-www-form-urlencoded
, the Spambot Check runs automatically on the browser of the Form End User following the Form Submission by running some JavaScript code on the "Spambot Check Page" to which the Form End User is redirected. If the browser does not run JavaScript, the spambot check does not succeed and no email is sent. - In case of a Form Submission made with header
Content-Type: application/json
, the Spambot Check does succeed without any actual verification.
3. User Responsibilities
- Accurate Information: Provide truthful and accurate information (email address) during account registration.
- Compliance: Use the Service in accordance with all applicable laws, including data protection and privacy regulations. Notably, the User is responsible for any implementation that will send an HTTP request to the Form Endpoint supplied by the Service, either using plain HTML forms handled by a browser on a website, or any other program responsible for sending HTTP requests.
- Prohibited Activities: The User must not:
- Use the Service for illegal or harmful purposes.
- Solicit a Form End User to submit sensitive or illegal content, such as personal health data, financial credentials, or prohibited materials.
- Interfere with the Service’s functionality or attempt unauthorized access to systems. In particular, the Administrator may disable or delete the User's account and associated data if any of the User's Forms are used to overload the Service with excessively frequent or large Form Submissions.
4. Email Credit, Pricing, Payment
The User has an initial "Email Credit" of 500 units and access to all features (see Description of Service).
One (1) unit of Email Credit is deducted when an email is successfully sent after a Form Submission (that is, not in case of malformed submissions or submissions with a failed Spambot Check). Email Credit is common to all the User's Forms and does not expire.
When Email Credit reaches a low point, the Service notifies the User by email.
If Email Credit reaches zero (0) units, no email will be sent anymore following a Form Submission.
Email Credit units can be purchased at any time by the User in addition to current Email Credit:
- +500 emails: $3.99 + VAT
- +2500 emails: $9.99 + VAT
VAT is calculated at checkout-time by Stripe, the payment processor used by the Service.
There are no subscriptions with recurrent fees, only one-time Email Credit purchases.
5. Data Privacy and Security
- Confidentiality: Form Submission data remains confidential to the Administrator and is not shared with any third party, except as required to send emails via email delivery services.
- Data Access: The User can request data deletion by contacting the Administrator. The request will be processed within one week.
6. Intellectual Property
All software, content, and trademarks on form-to-email.com are owned by the Service or its licensors. The User is granted a limited, non-exclusive license to use the Service in accordance with these Terms.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. The Service may be interrupted and may not meet the User's specific requirements. In particular, the Administrator does not guarantee that emails sent through the Service will be delivered successfully to all recipients, as this may depend on third-party email services or recipient server configurations. To the fullest extent permitted by law, the Administrator disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.
8. Limitation of Liability
The Administrator shall not be liable for:
- Indirect, incidental, or consequential damages arising from the use or inability to use the Service.
- Loss of data due to user errors, third-party services, or unforeseen technical issues.
The Administrator's total liability for any claim shall not exceed the amount you have paid to use the Service.
9. Modifications to Terms
The Administrator may revise these Terms from time to time. The date of the latest revision will be clearly indicated at the top of these Terms. Changes will take effect upon posting the updated Terms on our website, of which the User will be notified by email. Continued use of the Service after such updates constitutes acceptance of the modified Terms.
10. Termination
The Administrator reserves the right to suspend or terminate the User's access to the Service in case of violation of these Terms or misconduct that affects the Service or its Users.
